1. Introduction

4.2 App and Device Communications

If you use the UREVO App, connected devices, or other product-related features, UREVO may send you communications related to your use of such services and products, including app notifications, device-related notices, service updates, feature changes, and other information necessary to support or improve your experience.

You acknowledge that certain communications may be necessary for the operation, security, maintenance, or functionality of UREVO products, devices, or related services.

4.3 Service and Product Communications

UREVO may send you communications related to your account, purchases, products, and services, including order confirmations, transaction information, customer support communications, warranty-related information, product updates, and important notices regarding product safety or service changes where applicable.

use UREVO products, connected devices, and related services only for their intended purposes and in accordance with applicable instructions, guidelines, and safety information provided by UREVO;

use the Services in a manner that does not interfere with the operation, security, or availability of the Services or negatively affect other users’ access to the Services.

You are responsible for activities conducted through your account, except where such activities result from unauthorized access that is not caused by your actions or failure to protect your account.

5.3 Prohibited Activities

You may not access or use the Services to:

violate any applicable laws, regulations, or the rights of UREVO or any third party;

use the Services for fraudulent, harmful, or unauthorized purposes;

interfere with, disrupt, damage, or attempt to gain unauthorized access to the Services, UREVO systems, networks, or related technologies;

introduce viruses, malware, harmful code, or other materials that may affect the operation, security, or integrity of the Services;

access, collect, monitor, scrape, or extract information from the Services through unauthorized automated means;

copy, modify, reproduce, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or attempt to obtain the source code or underlying technology of any part of the Services, except where such restrictions are prohibited by applicable law;

bypass, disable, or interfere with any security features, access controls, or technical restrictions of the Services;

use the Services in any manner that may damage UREVO’s reputation, systems, products, or services.

UREVO reserves the right to take appropriate actions, including restricting or suspending access to the Services, where UREVO reasonably believes that a user has violated these Terms or applicable laws.

6. Purchases, Payments and Orders

6.1 Orders and Order Acceptance

When you place an order through the UREVO website or other authorized sales channels, you agree to provide accurate, complete, and current information necessary to process your order.

Your submission of an order constitutes an offer to purchase the selected products. UREVO’s receipt of your order does not constitute acceptance of your order. An order is accepted only when UREVO confirms acceptance of the order.

UREVO reserves the right to accept, reject, or cancel any order at any time for reasons including, but not limited to, product availability, errors in pricing or product information, suspected fraudulent activity, or other circumstances determined by UREVO.

If UREVO cancels an order after payment has been received, UREVO will provide a refund in accordance with applicable laws and UREVO’s applicable refund procedures.

Delivery times may vary depending on factors including product availability, shipping destination, carrier delays, customs procedures, weather conditions, and other circumstances beyond UREVO’s reasonable control.

You acknowledge that certain products, including larger fitness equipment such as treadmills or walking pads, may require additional delivery arrangements due to their size, weight, or shipping requirements.

UREVO is not responsible for delays caused by circumstances outside of UREVO’s reasonable control.

The transfer of ownership and risk of loss for products will be determined in accordance with applicable laws and the terms of the applicable transaction.

7. UREVO Products, Software and Services

7.1 Use of UREVO Products and Services

UREVO provides connected products, software, applications, and related services designed to support your use of UREVO products and enhance your experience, including treadmills, walking pads, other connected fitness equipment, the UREVO App, and related features.

Your use of UREVO products, including connected fitness equipment, the UREVO App, software features, and related services, is subject to these Terms and any applicable product documentation, user manuals, safety information, or guidelines provided by UREVO.

You agree to use UREVO products and related services only for their intended purposes and in accordance with applicable instructions and requirements. You are responsible for ensuring that your use of UREVO products is appropriate for your individual circumstances, including your physical condition and fitness level, and that you follow all applicable safety instructions.

7.2 Software and App License

Subject to your compliance with these Terms, UREVO grants you a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to access and use the UREVO App, software, firmware, and related features provided by UREVO solely for your personal use in connection with UREVO products and services.

Except as permitted by applicable law or expressly authorized by UREVO, you may not:

• copy, modify, distribute, sell, lease, sublicense, or otherwise transfer any software, application, firmware, or related technology provided by UREVO;
• reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying technology of any software or firmware;
• remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in UREVO software or services.

All rights not expressly granted under these Terms are reserved by UREVO and its licensors.

UREVO may from time to time provide updates, upgrades, patches, bug fixes, improvements, or modifications to UREVO products, software, firmware, the UREVO App, and related services.

Updates or modifications may change, add, or remove certain features or functionality of UREVO products, software, applications, or related services.

UREVO may modify, suspend, or discontinue certain features, functions, or services where reasonably necessary, including for technical, operational, security, or business reasons.

Where applicable, your continued use of updated software, applications, or connected services may require installation of updates or acceptance of additional terms.

7.4 Service Availability and Third-Party Services

Certain UREVO products and features may depend on internet connectivity, compatible mobile devices, Bluetooth connections, third-party networks, or other third-party services. You are responsible for ensuring that you have the necessary equipment, connections, and technical requirements to access and use such features.

UREVO does not guarantee that all products, services, applications, or features will be available at all times or in all locations.

You acknowledge that interruptions, delays, limitations, or changes may occur due to factors outside of UREVO’s reasonable control, including network failures, third-party service interruptions, maintenance activities, software updates, or other technical issues.

Your use of third-party services, including third-party applications, platforms, networks, or connectivity services, may be subject to separate terms and privacy policies provided by such third parties. UREVO is not responsible for third-party services or their availability.

8. Health and Safety Disclaimer

8.1 Exercise Risks and User Responsibility

You acknowledge that the use of fitness equipment and participation in physical activities involve inherent risks, including but not limited to physical injury, falls, muscle strain, fatigue, discomfort, or other health-related issues.

By using UREVO products, including treadmills, walking pads, and other connected fitness equipment, you voluntarily assume responsibility for your participation in physical activities, including walking, running, incline training, and other exercise activities, and agree to use the products in a safe and appropriate manner.

You are responsible for determining whether the use of UREVO products is suitable for your individual circumstances, including your age, physical condition, fitness level, prior exercise experience, and personal limitations.

Before beginning any exercise program or using UREVO products, you should consider consulting a qualified healthcare professional if you have any medical conditions, health concerns, injuries, or other circumstances that may affect your ability to exercise safely.

8.2 Medical Disclaimer

UREVO products, the UREVO App, and related services are designed to support fitness activities and provide information, tracking, and training-related features.

However, UREVO does not provide medical advice, diagnosis, treatment, or professional healthcare services. Any information, recommendations, workout features, or fitness-related content provided through UREVO products or services are intended for general informational and fitness purposes only.

You should not rely on UREVO products, the UREVO App, or related services as a substitute for professional medical advice, healthcare evaluation, or treatment.

If you experience pain, discomfort, dizziness, shortness of breath, unusual symptoms, or other health concerns while exercising, you should stop exercising and seek appropriate medical advice.

UREVO does not guarantee that any exercise program, use of UREVO products, or related services will achieve specific health, fitness, weight loss, or performance results.

8.3 Product Safety and Proper Use

You agree to use UREVO products in accordance with applicable user manuals, installation instructions, safety guidelines, and other documentation provided by UREVO.

You are responsible for:

• properly installing, positioning, operating, and maintaining your UREVO equipment;
• ensuring that the equipment is used in a suitable environment and under appropriate conditions;
• following all safety instructions, warnings, and usage requirements provided by UREVO;
• using the equipment only for its intended purpose.

You should not modify, alter, disassemble, repair, or otherwise interfere with UREVO products in any unauthorized manner, as improper use or modification may affect product performance and safety.

You should take appropriate precautions when using UREVO products, including keeping children and pets away from equipment during operation unless otherwise instructed by UREVO.

UREVO is not responsible for injuries, damages, or losses resulting from improper installation, misuse, unauthorized modification, unauthorized disassembly, failure to follow safety instructions, or use of UREVO products outside their intended purposes.

8.4 Fitness Data and Performance Information

Certain UREVO products and services may provide fitness-related information, including workout records, exercise metrics, estimated calories burned, distance, duration, speed, incline information, or other performance-related data.

You acknowledge that such information is provided for general fitness and tracking purposes only and may not always be completely accurate due to factors including device limitations, device settings, user input, environmental conditions, usage methods, and other technical factors.

Fitness data and performance information provided through UREVO products or services should not be interpreted as medical measurements, professional health assessments, or guarantees of fitness results.

UREVO does not guarantee the accuracy, completeness, or reliability of any fitness data or performance information provided through its products or services, nor does UREVO guarantee any specific health, fitness, weight loss, or performance outcomes.

9. Intellectual Property Rights

9.1 Ownership of UREVO Intellectual Property

All rights, title, and interest in and to UREVO’s intellectual property, including but not limited to the UREVO name, trademarks, logos, product designs, product specifications, software, firmware, applications, websites, text, graphics, images, videos, product descriptions, user manuals, marketing materials, fitness-related content, interfaces, and other materials provided through UREVO products and services, are owned by UREVO or its licensors and are protected by applicable intellectual property laws.

Your use of UREVO products, the UREVO App, websites, software, or related services does not grant you any ownership rights or interests in UREVO’s intellectual property.

All rights not expressly granted under these Terms are reserved by UREVO and its licensors.

9.2 Limited License to Use UREVO Services

Subject to your compliance with these Terms, UREVO grants you a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to access and use UREVO websites, applications, software, firmware, and related content solely for your personal and lawful use in connection with UREVO products and services.

This license does not transfer any ownership rights in UREVO intellectual property and does not grant you any right to commercially exploit, distribute, or otherwise use UREVO intellectual property except as expressly permitted under these Terms.

You may not:

• commercially exploit UREVO intellectual property;

You may not use automated tools, data extraction methods, scraping technologies, or similar processes to collect, copy, reproduce, or extract content, information, or materials from UREVO websites or services without UREVO’s prior written permission.

Due to the size and weight of certain UREVO fitness equipment, including treadmills and walking pads, additional return arrangements, shipping requirements, or procedures may apply.

Refunds, where approved, will be processed in accordance with UREVO’s applicable refund procedures, applicable payment methods, and applicable laws.

Unless otherwise required by applicable law, warranty coverage and return eligibility may not apply to issues resulting from:

• misuse, abuse, negligence, or improper use of UREVO products;
• failure to follow product instructions, safety guidelines, installation requirements, or maintenance recommendations;
• unauthorized repair, modification, alteration, disassembly, or other unauthorized intervention;
• normal wear and tear, cosmetic damage, or deterioration caused by ordinary use;
• consumable parts, accessories, or components subject to ordinary wear and replacement;
• damage caused by accidents, improper storage, transportation, environmental conditions, power issues, or external factors;
• use of products outside their intended purpose, specifications, or recommended conditions;
• commercial, rental, institutional, or other non-personal use unless expressly authorized by UREVO.

For fitness equipment, including treadmills, walking pads, and related products, proper installation, maintenance, and use in accordance with UREVO instructions are required to maintain product performance and warranty eligibility.

UREVO products, websites, applications, and related services may rely on or interact with certain third-party platforms, services, technologies, or providers, including but not limited to application distribution platforms, payment service providers, shipping and delivery providers, cloud service providers, device connectivity services, and other third-party service providers.

Certain features or functions of UREVO products, including connected device features, application functionality, and related services, may require interaction with third-party technologies or platforms.

Your access to or use of certain third-party services may be subject to additional terms, conditions, privacy policies, or requirements provided by such third parties.

You acknowledge that UREVO does not control, operate, or guarantee the availability, security, functionality, accuracy, or performance of third-party services. To the maximum extent permitted by applicable law, UREVO is not responsible for any loss, damage, interruption, or issue arising from your access to or use of third-party platforms or services.

UREVO does not control and is not responsible for the availability, accuracy, security, privacy practices, or content of any third-party websites, services, products, social media pages, or external resources.

Your access to and use of third-party websites, services, products, or resources is at your own risk and may be subject to separate terms, conditions, and privacy policies provided by the applicable third parties.

11.3 Third-Party Terms and Responsibilities

When accessing or using third-party services through UREVO products, applications, or websites, you are responsible for complying with all applicable third-party terms, conditions, policies, and requirements.

For example, applications downloaded through third-party application platforms, such as the Apple App Store or Google Play Store, may be subject to the terms, policies, and requirements of those platforms in addition to these Terms.

You acknowledge that your relationship with third-party service providers is solely between you and the applicable third party. UREVO does not assume responsibility for third-party services, products, platforms, or content unless otherwise required by applicable law.

UREVO reserves the right to modify, suspend, or discontinue any third-party integrations, features, or functionalities associated with UREVO products or services at any time to the extent permitted by applicable law.
